NEW YORK — A couple can proceed with a lawsuit against a fertility clinic they filed after the wife gave birth to a daughter whose skin they thought was too dark to be their child, a judge has ruled.

Thomas and Nancy Andrews, of Commack, N.Y., sued New York Medical Services for Reproductive Medicine, accusing the Manhattan clinic of medical malpractice and other offenses. They claim the Park Avenue clinic used another man's sperm to inseminate Nancy Andrews' eggs.

Three DNA tests — a home kit and two professional laboratory tests — confirmed that Thomas Andrews was not the baby's biological father, state Supreme Court Judge Sheila Abdus-Salaam quoted the couple as saying.

In an e-mail sent after the death of her son, Daniel, Anna Nicole Smith said that she wanted to die.

According to a report from "Entertainment Tonight," Smith's friends say they received an e-mail dated Oct. 8, 2006, that said, "I just wish I could be going thru good times now. I miss him. I want to die!"

Sources tell the entertainment show that Smith's companion, Howard K Stern, has cooperated with authorities and has given them permission to look at a computer, which they are examining.

It'll be on the "Law & Order: Criminal Intent" series, which has developed into the best whodunit piece of the "L&O" brand, as creator Dick Wolf likes to call it.

B ehind the Anna Nicole Smith circus lies an important truth about fathers' rights. The long line of opportunistic men who have lined up to be Smith's baby's dad since Smith's death has diverted attention from the case's key fact: photographer Larry Birkhead, Smith's ex-boyfriend, has a legitimate claim to paternity. He has been thwarted for several months by the same legal maneuvers which are often employed to separate fathers from their children.

Long before Smith died and her estate became an issue, Birkhead had filed for a DNA test to determine the paternity of Smith's baby. In December, he told the Associated Press, "I am the father of Dannielynn and I think this is ... a crime. I expect to be reunited with my daughter."

Birkhead say he and Smith had picked out baby names, shopped for items for the baby, and had put their thumb prints in a baby book as the child's parents. Nevertheless, the baby has lived at the home of Smith and her attorney/boyfriend Howard K. Stern in the Bahamas since birth.

An attorney for Smith's estate says the judge presiding over the dispute in the Bahamas has scheduled a hearing for March. The battle involves Smith's companion, her estranged mother and an ex-boyfriend who claims he's the father.

Smith's mother, Virgie Arthur, is trying to get guardianship from Smith's companion, Howard K. Stern, who is listed as the father on the birth certificate. An attorney for Smith's former boyfriend, Larry Birkhead, says she expects D-N-A testing.

A judge who had a secondary role in the recent Anna Nicole Smith proceedings was charged with smoking marijuana in a city park, police said Monday.

Lawrence Korda was smoking marijuana while sitting under a tree Sunday, police said. Three officers who were training there saw Korda and field-tested the cigarette, said Capt. Tony Rode, a police spokesman.

The judge was not arrested. He was given a misdemeanor citation to appear in court.

I admit it. I watched portions of the Anna Nicole Smith custody hearing last week. Not, mind you, because I intended to, but because Im in the habit of keeping a muted TV set turned on in case some real news might intrude on the daily gossip roundups and grave reports of snow in February. After reading somewhere about the odd conduct of the judge in the case, when Fox News went to live court coverage, I decided to see for myself.

Usually, contact with network or cable television fare leaves me merely disgusted, but the sounds and sights of the goings-on in this case produced in me a profound state of sadness. Not just for Smith herself or her family, or the sorry cast of shysters, finaglers and hangers-on that modern wealth and fame seem to produce; but for our country. In a way, her piteous saga is a microcosm of much that is wrong in our once blessed and morally prosperous society.

Smiths is a modern-day American success story. She saw what she wanted and went out and got it. A sugar daddy, a new body and her own reality-TV show; in short, everything the new all-American girl could want. The price? Not too expensive when you consider that sex is todays currency. Its not a new story either; in fact, its one of the worlds oldest.

Celebrity-attorney Debra Opri announced Friday that she is no longer representing Larry Birkhead, the photographer who says he's the father of Anna Nicole Smith's baby.

"Larry Birkhead and I have terminated our attorney-client relationship effective immediately. I wish Larry the very best of luck in his continuing efforts to prove that he is Dannielynn's biological father. My prayers will be with Larry and Dannielynn always," a statement said.

The Web site TMZ reported Friday that it was Birkhead who terminated the relationship and that they had been butting heads over various issues for weeks.

LOS ANGELES (AP) - One of the men who claims to be the father of Anna Nicole Smith's baby is splitting with the high-profile Beverly Hills attorney who has been representing him in the case.

Larry Birkhead and Debra Opri "have terminated our attorney-client relationship effective immediately," Opri said in a statement Friday.

"I wish Larry the very best of luck in his continuing efforts to prove that he is Dannielynn's biological father. My prayers will be with Larry and Dannielynn always," Opri said.

Next week is expected to be an important week in the Anna Nicole Smith case.

Not only is the medical examiners office in Broward expected to release her official cause of death, but a court ordered DNA test on her baby daughter Dannielynn is expected in the Bahamas. The test is expected to, once and for all, settle who is the babys father.

"I can't say what happened today, but Im happy and in a great mood and we'll see. I'll be back here Tuesday," said Larry Birkhead.

NASSAU, Bahamas -- There's to be another court hearing on Friday in the continuing saga over the late star-crossed celebrity Anna Nicole Smith.

It is in the Bahamas and it's a tussle over who gets custody of Smith's baby daughter, Dannielynn.

Several people claim to be the father. Lawyers for one of them, ex-boyfriend, Larry Birkhead, are asking for a DNA test.

Prince Frederic von Anhalt sued the Fox Network and Bill O'Reilly after the popular talk show host called Von Anhalt a "fraud" for saying he could be the father of Anna Nicole Smith's baby.

Von Anhalt, the husband of actress Zsa Zsa Gabor and one of three men to file a paternity claim for Smith's 6-month-old daughter, filed the defamation lawsuit against Fox and O'Reilly on Wednesday in Los Angeles County Superior Court. He is seeking $10 million in damages.

O'Reilly, host of "The O'Reilly Factor," challenged Von Anhalt to take a lie detector test after he filed the paternity claim in mid-February. Von Anhalt initially accepted but later changed his mind when he learned how long the test would take, said Edward Lee, his attorney.
